The Government of India has implemented a comprehensive regulatory framework to manage the online gaming industry, marking a significant regulatory development. Effective from May 1, 2026, this framework follows the enactment of the 2025 Promotion and Regulation of Online Gaming Bill, which prohibited real-money online gambling. The initiative is aimed at clearly distinguishing between online money games, e-sports, and social games, amid increasing scrutiny on online gambling activities.
The new framework introduces the Promotion and Regulation of Online Gaming (PROG) Act 2025, alongside the Promotion and Regulation of Online Gaming Rules 2026, which were initially released on April 22, 2026. These regulations establish a central regulator tasked with overseeing the classification of games into two categories: online money games and permissible social games or e-sports. This classification is crucial as it dictates the legality of the games and their regulatory requirements. Online money games, characterized by user fees or stakes with the potential for monetary gains, are prohibited under the current framework. In contrast, social games and e-sports, which are permitted, must adhere to strict safeguards.
The Online Gaming Authority of India (OGAI), a newly formed regulatory body under the Ministry of Electronics and Information Technology (MeitY), will be central to the enforcement of these regulations. Based in Delhi, OGAI will be responsible for maintaining a list of prohibited games, conducting inquiries, issuing directives, and setting codes of practice. This body will also handle grievances from users, a crucial function in ensuring compliance and addressing consumer concerns.
The framework mandates that only games recognized by the central government, based on factors such as risk to users, transaction scale, and origin, need to register under the new regulations. Games seeking recognition as e-sports must also register. Registration will result in a digital Certificate of Registration valid for ten years. However, any game identified as an online money game will be disqualified from being recognized as an e-sport under the National Sports Governance Act 2025.
User protection is a key focus of the new rules, with requirements for age verification, time limits on usage, and parental controls. Platforms must also provide in-app reporting and counseling support, along with systems to ensure fair play. These measures aim to safeguard users, particularly minors, and ensure transparency in the gaming environment.
A two-tier grievance redressal system has been established, allowing dissatisfied users to appeal decisions within 30 days. If unresolved, they can escalate the matter to OGAI, which aims to resolve such cases promptly. An additional appeal can be made to the Secretary of MeitY if necessary. The framework emphasizes digital investigations and enforcement processes, with a goal of resolving cases within 90 days of a complaint.
Penalties for violations will be proportionate to the severity of the offense, taking into account factors such as user harm and remedial efforts. The regulations also aim to prevent financial institutions from facilitating transactions related to prohibited games, necessitating close coordination between OGAI and financial regulators. This could impact the dynamics of in-app purchases and related financial transactions.
The new regulatory framework reflects India’s efforts to address the challenges posed by the online gaming sector, particularly in mitigating the risks associated with online gambling. The establishment of OGAI and the introduction of clear classification criteria are expected to bring greater oversight and structure to the industry.
Looking ahead, the Online Gaming Authority of India will focus on publishing the official list of prohibited online money games and processing game registrations under the new regime. This initiative is likely to shape the future of the online gaming market in India, offering clearer boundaries and enhanced consumer protections within the sector.
