The Chilean Casino and Gaming Association (ACCJ) has expressed strong approval of the recent decision by Chile’s Supreme Court mandating the blockage of illegal online gambling sites. On Tuesday, the Supreme Court’s Third Chamber voted three to two in favor of an order compelling internet service providers to block access to unauthorized sports betting websites throughout Chile. This ruling came in response to a protection appeal lodged by the Concepción Lottery and overturns a previous lower court decision from April that had denied the blocking of these illegal platforms.
The ruling from the Supreme Court emphasized the illegal nature of refusing to block such platforms, noting that only entities with proper legal authorisation are permitted to offer online sports betting services. It pointed out that unauthorized sites infringe upon the exclusive concession rights of the lottery, thereby breaching the constitutional guarantees of property.
As per the current legal framework in Chile, gambling activities are prohibited unless conducted by the Concepción Lottery, Polla Chilena, racetracks, or officially sanctioned gambling casinos. This new mandate requires internet service providers including Claro Chile and Empresa Nacional de Telecomunicaciones to immediately restrict access to any websites listed by the Concepción Lottery.
The Supreme Court articulated its directive clearly, stating, “It is hereby ordered that the respondents may not broadcast or promote games of chance unless they provide legal authorisation and authorisation from the administrative authority.”
